The given examples are clearly not marketing emails. As a previous customer, a change to current privacy policy is still relevant.

Cloudflare still sends marketing emails to registered users, but they've improved their opt-out process since 2020 with a clearer unsubscribe link at the bottom of all communications that actually works.

No, you're missing the point. Also one or more of the emails are not marketing emails.
The point is that they say they delete your data, but actually don't.

The issue isn’t that they are emailing, or even that he is receiving the emails. The issue is that they are not deleting his data even after they pinky promised they did.
